Labour Code of the Republic of Kazakhstan
Regulates employment relations: employment contracts, working time and rest, pay, labour disputes, collective agreements and occupational safety. For oil and gas the rules on rotational (shift camp) work and on work in harmful conditions are especially important.
What matters for an oil & gas company
- Normal working time is at most 40 hours a week; summarised working-time accounting is allowed, for rotational work over a period of up to one year.
- A rotation (vakhta) may not exceed 15 calendar days, or 30 days with the worker's written consent (up to 120 days for sea vessel crews); the employer provides housing, meals and transport from the assembly point.
- Individual labour disputes go first to a conciliation commission and then to court (the commission stage does not apply to micro-businesses, company executives and some other categories).
- Workplaces must be attested for working conditions at least once every five years; workers in harmful conditions get guarantees, including an employer-funded professional payment from age 55 under the conditions of the Code.
- Employers enter data on concluded, amended and terminated employment contracts into the unified employment contract accounting system.
