Main Pipeline Law
Law of the Republic of Kazakhstan “On Main Pipeline”
Regulates design, construction, operation, conservation and decommissioning of main pipelines for oil, petroleum products and gas, and transportation services through them. It sets ownership rules, state participation, protection zones and the rights of owners, operators and shippers.
What matters for an oil & gas company
- A main pipeline is an indivisible property complex; the pipeline and shares in its owner and in persons controlling the owner are strategic objects.
- The state has a priority right to take at least a 51% share in any new main pipeline project.
- Transportation is provided under contracts between the owner or operator and the shipper; oil moves along existing routes under a transportation schedule, and a quality bank may apply.
- Protection zones with a special land-use regime are set along routes and around facilities; building unrelated structures within the minimum distances is prohibited.
