Law of the Republic of Kazakhstan “On Compulsory Environmental Insurance”
Requires operators of environmentally hazardous activities to insure their interest linked to the duty to remediate environmental damage caused by an accident. The separate law remains in force: it was not absorbed into the 2021 Environmental Code but amended to fit it, and the Code refers to it directly.
What matters for an oil & gas company
- Facilities on the list of environmentally hazardous activities approved by the environmental authority may not be operated without a compulsory environmental insurance contract (Environmental Code, Article 129).
- The insured interest is the operator's obligation to remediate environmental damage caused by an accident.
- The Law was aligned with the new Environmental Code by Law No. 401-VI of 2 January 2021; further changes (including the financial ombudsman) take effect on 1 January 2027.
