Code of the Republic of Kazakhstan “On Administrative Infractions”
Defines administrative offences, penalties and the procedure for handling cases. For oil and gas companies it sets fines for breaches of subsoil, environmental, industrial safety, pipeline, gas supply and fuel-market rules. In force since 1 January 2015.
What matters for an oil & gas company
- Fines are set in monthly calculation indices (MCI) and differ for small, medium and large businesses.
- Breaching the conditions of hydrocarbon subsoil operations or project documents: up to 1,000 MCI for large businesses; prospecting, appraisal or production works without approved project documents: up to 2,000 MCI (Article 356).
- Environmental offences include non-compliance with environmental permit conditions (Article 326) and exceeding greenhouse-gas quotas (Article 329).
- Damage to oil and gas pipelines (Article 308), breach of main pipeline protection rules (Article 635), violations of gas supply law (Article 170) and exceeding price caps for petroleum products, commercial gas and LPG (Article 171) are separate offences.
