Hazardous Facility Liability Insurance Law
Law of the Republic of Kazakhstan “On Compulsory Insurance of Civil Liability of Owners of Objects Whose Activity Is Fraught with Risk of Causing Damage to Third Parties”
Requires owners of hazardous production facilities that are subject to industrial safety declaration to insure their civil liability for harm to the life, health and property of third parties caused by accidents. Many oil and gas facilities — fields, pipelines, processing plants — fall under it if they are declarable.
What matters for an oil & gas company
- Owners of facilities subject to industrial safety declaration under the Law on Civil Protection must insure their liability.
- Operating such a facility without a compulsory insurance contract is prohibited; voluntary insurance or letting another person use the facility does not remove the owner's duty to insure.
- The insurance covers the owner's liability for harm caused to third parties by hazardous production factors during accidents.
- Changes adopted by Law No. 259-VIII of 16 January 2026 take effect on 1 January 2027.
