Law of the Republic of Kazakhstan “On Gas and Gas Supply”
Regulates the gas supply chain: production of commercial gas, transportation, storage, wholesale and retail sale of commercial gas and LPG, and gasification. It gives the state, through the national operator, rights to buy gas from subsoil users and to acquire gas supply assets.
What matters for an oil & gas company
- The state, through the national operator (JSC NC QazaqGaz), has a pre-emptive right to buy raw and commercial gas that subsoil users sell; the price covers production, processing and transport costs plus a margin of up to 10%.
- For gas from new areas under contracts signed after 1 January 2023 (and some other cases), the commercial gas price is based on the average of domestic wholesale price caps and export prices, less transport costs and the operator's margin.
- The state has a priority right to acquire assets of the unified commercial gas supply system and shares in their owners.
- The state may cap wholesale prices of commercial gas on the domestic market and prices of LPG sold under the supply plan.
- Associated gas owned by the state can be transferred to an investor for processing under a gas partnership agreement.
