Natural Monopolies Law
Law of the Republic of Kazakhstan “On Natural Monopolies”
Regulates natural monopolies, including transportation of oil and gas by main pipelines and gas distribution, through state approval of tariffs and investment programmes. It matters both for pipeline operators and for producers that use their services on the domestic market.
What matters for an oil & gas company
- Regulated services include transportation of oil and petroleum products by main pipelines, storage and transportation of commercial gas by connecting and main gas pipelines and distribution systems, and transportation of raw gas by connecting pipelines — excluding transit and export.
- Tariffs are approved by the authorised body using cost-based, incentive or indexation methods, together with investment programmes.
- Natural monopoly entities follow special procurement rules and must give consumers access to regulated services.
- Replaced the 1998 Law on Natural Monopolies from 15 January 2019.
