Civil Code of the Republic of Kazakhstan (Special Part)
Regulates specific contracts and obligations — sale and supply, lease, work and construction contracts, services, carriage, loans, insurance, agency and others — as well as intellectual property, liability for harm and private international law. In force since 1 July 1999.
What matters for an oil & gas company
- Sets default rules for supply, lease, work (including construction) and service contracts widely used between operators and oilfield service companies.
- Persons whose activities create increased danger (industrial enterprises, construction sites, vehicle owners and others) must compensate harm unless they prove force majeure or the victim's intent (Article 931).
- Parties to a contract with a foreign element may choose the governing law (Article 1112); without a choice, the Code sets the applicable law by contract type, e.g. the seller's country for a sale contract (Article 1113).
- Protects intellectual property, including undisclosed information (know-how).
