Entrepreneurial Code

Entrepreneur Code of the Republic of Kazakhstan

Sets the framework for relations between business and the state: state regulation and control (inspections), price regulation, competition law, state support and investment protection. In force since 1 January 2016.

What matters for an oil & gas company

  • State control and supervision are risk-based: inspections and preventive control follow a risk assessment and management system.
  • Competition law: abuse of dominance, anti-competitive agreements and unfair competition are prohibited; economic concentration (e.g. acquiring more than 50% of voting shares) is regulated by the antimonopoly authority.
  • Investors are guaranteed legal protection and stability of contracts with state bodies (except changes agreed by the parties); investment preferences are granted under investment contracts; investment disputes go to negotiations, courts or agreed arbitration.
  • Prices on socially significant markets are regulated by the state, including retail sale of commercial gas and of LPG through group tank installations.
