Quasi-Public Procurement Law
Law of the Republic of Kazakhstan “On Procurement by Certain Quasi-Public Sector Entities”
Sets procurement rules for national managing holdings (such as the National Wealth Fund), national holdings and national companies and for entities at least 50% owned by them. It matters for suppliers to state-owned oil, gas and pipeline groups. In force since 1 January 2022.
What matters for an oil & gas company
- Procurement runs through the procurement web portal (except special cases), where procurement plans are also published.
- Methods: tender, auction, request for price proposals, single source and electronic shop; auctions are not used by the Fund and its organisations.
- Suppliers that evade signing a contract, give false information or fail to perform are entered in the register of unreliable procurement participants.
- Support for Kazakhstani producers is one of the principles, and procurement takes into account the Law on Industrial Policy.
