Govern the purchase of goods, works and services by hydrocarbon subsoil users and their contractors: permitted procurement methods, mandatory use of the goods/works/services register (e-procurement), annual and medium-term procurement programmes and preferences for Kazakhstani producers.
What matters for an oil & gas company
- Methods: open tender, single source, open reverse tender (e-auction), commodity exchange, and purchases outside these methods under an approved list; the first three must be run through the register.
- When tenders are evaluated, bids of Kazakhstani producers of works and services are conditionally reduced by 20% (Art. 131 of the Code).
- Do not apply to subsoil users buying under public procurement law, entities 50%+ owned by the national managing holding, natural monopolies, and 'complex projects' under Article 36(1-2) of the Code.
