Govern the purchase of goods, works and services by hydrocarbon subsoil users and their contractors: permitted procurement methods, mandatory use of the goods/works/services register (e-procurement), annual and medium-term procurement programmes and preferences for Kazakhstani producers.
What matters for an oil & gas company
- Methods: open tender, single source, open reverse tender (e-auction), commodity exchange, and purchases outside these methods under an approved list; the first three must be run through the register.
- In open tenders and reverse e-auctions the price offer of a Kazakhstani producer of goods, works or services is conditionally reduced by 20% (the 'conditional price', para. 4 of the Rules; for works and services also Art. 131 of the Code).
- Do not apply to subsoil users buying under public procurement law, entities 50%+ owned by the national managing holding, natural monopolies, and 'complex projects' under Article 36(1-2) of the Code.
- Order No. 276-н/қ of 21.07.2026: prices are compared in tenge at the National Bank's official rate on the evaluation date and the reverse e-auction step is 1% (at most 100,000 tenge); if the official tenge rate moves by more than 10% before the contract is signed or paid, the parties may recalculate the amount by mutual agreement, with a justification and cost breakdown.
