Raw gas flaring permit rules
On approval of the Rules for issuing permits for flaring of raw gas

The amendments of 28 August 2026 are in force but not yet in the official text on Adilet. The summary below describes the previous version.
Set out how the Ministry of Energy issues permits to flare raw gas in the three cases where the Subsoil Code allows flaring with a permit: well-object testing, trial production of a field and technologically unavoidable flaring. Flared volumes must stay within norms calculated under the approved methodology.
What matters for an oil & gas company
- Permits are issued only for well-object testing (based on an approved project document, up to 90 days per object), trial production and technologically unavoidable flaring; emergency flaring needs no permit but must be reported to the authorities within 10 days (Art. 146 of the Code).
- Applications are filed through the e-government portal (egov.kz, elicense.kz); the service term is 8 working days for well testing and 2 working days for trial production and technologically unavoidable flaring.
- The requested flaring period may not exceed the exploration or production period, or the validity of the project document and of the approved raw gas processing development programme.
- The latest amendments (Order No. 328-н/қ of 28.08.2026) revised application handling, including grounds for suspending the service and a deadline for correcting deficiencies.
