Land Code of the Republic of Kazakhstan
Regulates land ownership and land use: land categories, provision of land plots, lease (temporary land use), easements, seizure for state needs and land protection. Oil and gas companies obtain land for exploration, production, pipelines and other facilities under this Code.
What matters for an oil & gas company
- Land for subsoil operations is provided only after the subsoil use licence or contract is obtained; for production it is leased (temporary paid land use) for the whole term of the licence or contract.
- Geological study and exploration can be carried out on land of others under a public easement without withdrawing the land; the subsoil user pays the fee and compensates losses.
- When the subsoil use right is transferred, the land lease is re-registered to the new holder; from 8 September 2026 holders of hydrocarbon contracts may sublease plots to another subsoil user working on a shared territory.
- Land owners and users must protect land from pollution and degradation, strip and keep the topsoil and reclaim disturbed land.
