Law of the Republic of Kazakhstan “On Currency Regulation and Currency Control”
Governs foreign-currency operations of residents and non-residents, accounts in foreign banks, repatriation of export and import proceeds, and the National Bank's monitoring and control of currency operations. In force since 1 July 2019.
What matters for an oil & gas company
- Residents must repatriate export proceeds, and funds paid for imports that were not delivered, to accounts in Kazakhstani authorised banks within the term set by the contract.
- Capital-movement currency contracts (e.g. loans, equity contributions) receive a National Bank accounting number before performance and are then reported on.
- Resident legal entities notify the National Bank of accounts opened in foreign banks before using them and report operations on those accounts.
- In a serious threat to the balance of payments, the Government may introduce a temporary special regime for certain currency operations.
